Terms and Conditions
All contractual relationships between the seller, being Galard Brno s.r.o., with its registered office at Údolní 552/31, 602 00 Brno, Company ID No.: 29273200, or Galard Praha s.r.o., with its registered office at Petrská 1132/4, 110 00 Prague 1, Company ID No.: 02596598 (hereinafter referred to as the “Seller”), and the customer (hereinafter referred to as the “Buyer”) are governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.
These Terms and Conditions govern the mutual rights and obligations of the Seller and the Buyer and form an integral part of the purchase agreement concluded between the Seller and the Buyer.
Subject of the Contract
For the purposes of these Terms and Conditions, the term product or goods shall mean movable items offered by the Seller, in particular textiles, textile products, garments, clothing accessories and other related products.
A special category consists of products made to order according to the Buyer’s individual requirements, in particular bespoke suits, made-to-measure shirts and other custom-made products (hereinafter referred to as “Custom-Made Products”).
Conclusion of the Contract and Payment
The purchase agreement is concluded at the moment the advance invoice, receipt or tax document issued by the Seller is paid by the Buyer.
In the case of Custom-Made Products, the Seller is entitled to require an advance payment of up to 100% of the total price, typically 50%, taking into account the individual nature of the performance and the impossibility of reselling such products to third parties.
Buyer’s Cooperation
Custom-made production requires the Buyer’s active cooperation, in particular personal attendance at a minimum of two fittings at the Seller’s premises, unless otherwise agreed.
If the Buyer fails to provide the necessary cooperation, the Seller shall not be liable for failure to meet the agreed delivery date.
Withdrawal from the Contract
The Buyer acknowledges that, in accordance with Section 1837 of the Civil Code, it is not possible to withdraw from a contract the subject of which is Custom-Made Products manufactured according to the Buyer’s individual requirements.
Complaints and Liability
An integral part of these Terms and Conditions is the Complaints Procedure, with which the Buyer may familiarize themselves in printed form at the Seller’s premises. A copy shall be provided to the Buyer upon request.
Changes to the product resulting from normal wear and tear, natural properties of the material, improper use, insufficient maintenance, or unprofessional intervention by the Buyer or a third party shall not be considered defects and shall not constitute grounds for a valid complaint.
Final Provisions
These Terms and Conditions shall become effective on 1 January 2026.
